SHELL ACCOUNTS
Customer agrees not to store, send, or download any illegal files, documents, or applications from Provider. Customer also agrees not to have any bots or irc clients participating or aiding in the transferring of said files. This includes, but is not limited to, commercial software (.warez.), licensed music files (.mp3.) or copyrighted movies (.vcds.). Failure to comply with these terms may result in legal consequences, account termination/suspension, or deletion of the files and/or your account. Launching IRC bots (if applicable) on an IRC channel that is takenover, or channel without any ops with the intent to prevent ownership or hold illegal ownership of a channel that was takenover is grounds for account termination. Using your account to provoke an attack, or to participate in the unwanted ownership change in a channel is also strictly prohibited. You are responsible for your bots, by linking to a botnet, you are taking full responsibility for the other botnet owners' actions.
Putting IRC bots (if applicable) on an IRC server that does NOT allow them or running more than the specified amount per IRC network is grounds for account deletion or account contents deletion. You are required to follow and adhere to the IRC server's rules. Connection laws and limits are governed soley by the IRC server or network, and should always supercede Provider's recommended connection limits.
Running unapproved background/foreground processes which hog cpu/bandwidth such as, but not limited to, "Game" Servers or other Streaming Media, IRCDs on non-IRCD accounts, IRCD Services or XDCC bots. If you are unsure whether a process is approved for use on your shell account, contact us.

# Attempting to access the accounts of others, probing for security holes, or attempting to penetrate security measures of Provider's or other entities' systems ("hacking"), whether or not the attempt results in an intrusion, corruption, or loss of data is grounds for legal action and immediate account termination.
Certain "tools" used for malicious purposes include: Probing or Scanning tools, such as "nmap", "strobe".
Exploits or Malicious Code (remotely or locally).
or Denial of Service, such as "smurf", "fraggle", "udpflood" are also prohibited. Storing or executing these types of files on your account is grounds for termination.

USE OF IRC SERVERS & CONNECTION LIMITS
Each individual shell account is not permitted to make more than two (2) connections to any "IRC server". IRC community networks such as Undernet have strict network-wide cloning/maximum connection limits. In this instance, you cannot make more than two connections to the entire IRC network from the same shell account. Additionally, not more than two (2) connections can be made to any single "bnc" process running on ServerOrigin servers. BNCs and eggdrops which spawn more than 2 connections to the same server or network are subject to suspension and grounds for account termination after investigation. Access to all third party IRC servers, networks, or communities are not guaranteed and is not considered part of Provider's service agreement. BitchX sessions and IRC sessions run on the shell account by default will put your Real Name into the Real Name/IRCname field. This information will show up in a /whois. If you do not wish for this information to be shown when you log on IRC via the shell, it is for your own privacy that we suggest you change it by typing "ircname" at the shell prompt.

SECURITY
Information transmitted over the Internet and/or other computer networks is generally not considered to be secure. While Provider respects the privacy of our customers, the Customer understands that there is no guaranteed privacy on the Internet. Provider cannot be liable or responsible for any viewing or interception of Customer's e-mail, downloads, news, etc., by other customers or individuals at Provider or on any network. The Customer also acknolwedges that although network and server backups are performed regularly as a courtesy, Provider cannot be liable or responsible for any loss of data, or for any security holes in Customer applications.
VPS Servers: User is liable for securing and administering your own VPS Servers. Our servers are unmanaged and we highly recommend having working knowledge prior to signing up with a VPS as you could be held responsible if your server is hacked and used maliciously.

HIGH RESOURCE USER POLICY
Resources are defined as bandwidth and/or processor utilization. ServerOrigin.Com may implement the following policy to its sole discretion:

When a website is found to be monopolizing the resources available, ServerOrigin.Com Reserves the right to suspend that site immediately. This policy is only implemented in extreme circumstances and is intended to prevent the misuse of our servers.

MAILING LISTS AND/OR UNSOLICITED MAILINGS (SPAM)
ServerOrigin, strictly prohibits the use of their servers to send or relay unsolicited mail (SPAM). If any domain hosted by ServerOrigin participates in the sending of unsolicited mail, unsolicited bulk mailings, unsolicited spot mailings or any other form of mailing commonly known as SPAM, the domain will be cancelled immediately. Inadvertent spam will be subject to a processing fee in the amount of $100 per infraction.

Termination of the hosting account on our servers applies when we are advised form an appropriate source that the SPAM was distributed through our network. ServerOrigin does not support the practice of SPAM and will terminate their association with any company hosted by our servers if that company has been identified as the source of unsolicited email/SPAM. All information stored on ServerOrigin servers will be removed immediately, DNS will be terminated, and mail will be stopped.

PAYMENT POLICIES
All accounts are set up on a prepay basis. Although ServerOrigin.Com Reserves the right to change prices of accounts or services at any time all pricing is guaranteed for the period of pre-payment.

Payment is due each anniversary year or month following the date the account was established.
Customers WILL automatically be charged again at the end of their prepay period .

In situations where the card number on file is declined ServerOrigin.Com Will immediately suspend the facility to purchase services on-line until the outstanding charge is processed successfully.
In addition, ServerOrigin.Com Reserves the right to suspend other services until the outstanding debt is cleared. The customer is responsible for all money owed on the account from the time it was To reactivate a suspended account (due payment problem) a $5 reactivating fee must be paid for each suspended domain/account.
Established to the time that the customer sends a written cancellation request

No bills or invoices will be sent by regular mail. All invoices will be sent directly to customers via e-mail shortly after the online purchase has been made. At this point the customer's card will be charged automatically. Bandwidth Overage is billed at $1.00/GB of usage and will be due at the end of your billing cycle.All payments are accepted in US dollars.

PAYMENT OPTIONS
In order to streamline our accounting procedures and keep costs down ServerOrigin.Com Accepts Google Checkout, PayPal, and Money Orders..

CANCELLATION AND REFUNDS
ServerOrigin.Com Reserves the right to cancel the service at any time. Customer refund requests are to be sent to billing@serverorigin.com and will only be processed in the cases of service non-performance within 30 days of signup that might be caused by ServerOrigin.Com's side, Refund requests will be refused if it's requested for any cause that's out of ServerOrigin.Com's side, For example:
- Domain transfer failure.
- Failure of any third party programs that's not supported by ServerOrigin.Com
- Customers lack of experience in dealing with web basics and irc communication protocols

There will be a $5.00 charge for each refund. If your monthly invoice is below $5.00, no refund will be processed.

INDEMNIFICATION
Customer agrees that it shall defend, indemnify, save and hold ServerOrigin.Com Harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against ServerOrigin.Com, Its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless ServerOrigin.Com Against liabilities arising out of:
(1) any injury to person or property caused by any products sold or otherwise distributed in
connection with ServerOrigin.Com's server.
(2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party.
(3) copyright infringement.
(4) any defective products sold to customer from ServerOrigin.Com's server.

DISCLAIMER
ServerOrigin.Com Will not be responsible for any damages your business may suffer, ServerOrigin.Com Makes no warranties of any kind, expressed or implied for services we provide.
ServerOrigin.Com Disclaims any warranter merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, non deliveries, wrong delivery, and any and all service interruptions caused by ServerOrigin.Com and its employees.
